Discussions of global ethics—about the types of ethical claim made on individuals and groups, not only states, by individuals and groups around the world—have had to move beyond the categories inherited in the International Relations discipline. Many important positions are not captured by a framework developed for discussion of inter-state relations. The blindspots seem to reflect an outmoded expectation that (i) giving low normative weight to national boundaries correlates strongly with (ii) giving more normative weight to people beyond one's national (...) boundaries, and vice versa; in other words that these two dimensions in practice reduce to one. The paper develops an enriched categorisation. We need to recognise the separate importance of the two dimensions, and thus distinguish various types of ‘cosmopolitan’ position, including many varieties of libertarian position which give neither national boundaries nor pan-human obligations much (if any) importance. Work on global ethics looks at ethical connections on a global scale. It should link closely to environmental ethics, recognizing that we live in unified social-ecological systems, and to development ethics, attending systematically to the lives and interests of contemporary and future poor, marginal and vulnerable persons and groups within these systems and to the effects on them of forces around the globe. Fulfilling these tasks requires awareness of work outside academic ethics alone, in other disciplines and across disciplines, in (...) public debates and private agendas. A relevant ethics enterprise must engage in systematic description and understanding of the ethical stances that are expressed or hidden in the work of influential stakeholders and analysts, and seek to influence and participate, indeed embed itself, in the expressed and hidden choice-making involved in designing and conducting scientific research and in policy analysis and preparation; it will contribute in value-critical and interpretive policy analysis. It will explore how the allocation of attention and of concern in research and policy depend on perceptions of identity and of degrees of interconnection, and are influenced by the choice or avoidance of humanistic interpretive methodologies. The paper assesses the rationale, contributions, structure, and challenges of the field of development ethics. Processes of social and economic transformation involve great risks and costs and great opportunities for gain, but the benefits, costs, and risks are typically hugely unevenly and inequitably distributed, as is participation in specifying what they are and their relative importance. The ethics of development examines the benefits, costs, risks, formulations, participation, and options. The paper outlines a series of ways of characterizing such work, arguments (...) for and against its importance, and some of its major sources and contributions, especially from the interdisciplinary stream of work represented over several decades by Denis Goulet. Definitions are diverse since the work covers many different intersections of practice and theorizing, at multiple levels. The paper considers and replies to arguments against discussing development ethics: the claim that it involves only endless proliferation of different opinions, is an expensive luxury that undermines long-run development, is superfluous if one already works with the capability approach or the human rights tradition, or never has influence. Finally, it presents suggestions for how development ethics thinking can have increased impact, with reference to incorporation in policy analysis and planning methods, professional codes and training, and to its intellectual location and communication strategies. The field should articulate the methodological pragmatism which much of it has adopted, consistent with its required role as a practice-oriented interdisciplinary meeting ground. (shrink)

The language of ‘human security’ arose in the 1990s, including from UN work on ‘human development’. What contributions can it make, if any, to the understanding and especially the valuation of and response to the impacts of climate change? How does it compare and relate to other languages used in describing the emergent crises and in seeking to guide response, including languages of ‘externalities’, public goods and incentives, cost-benefit and cost-effectiveness analysis? The paper examines in particular the formulations in those (...) terms in Stiglitz's Making Globalization Work and Stern's The Economics of Climate Change and Blueprint for a Safer Planet, and how these authors are left groping for frameworks to motivate the changes required for global sustainability. It undertakes comparison also with the languages of human development and human rights, and suggests that, not least through enriching our skills of ‘narrative imagination’, the human security framework supports a series of essential changes in orientation—in our conceptions of selfhood, well-being and situatedness in Nature—and supports a required greater solidarity and greater awareness of our inter-connectedness. This paper presents a structured comparison of the social quality approach with the UNDP-led 'human development' approach and its sister work on 'human security'. Through clarification of their respective foci, roles and underlying theoretical and value assumptions, the paper suggests that partnership of the social quality approach with these 'human' approaches appears possible and relevant for each side.

Several insider accounts of the formation of the Sustainable Development Goals suggest that the process (the procedures used and the emergent organizational and governance system features) was as important as the resulting goal-set. The paper looks at both aspects, and relationships between them: the rising influence of Southern nations (seen in the roles played by Colombia, Brazil, some African countries and the G77); the partial transcendence of traditional inter-bloc negotiation, including through adoption of elements of deliberative decision-making; the major involvement (...) of civil society and business organizations, thanks especially to the IT revolution; the adoption of a goals-targets-indicators frame that has flexibility at national level and implicit reliance on intensive further civil society activism and monitoring. The paper considers these features and the implied prospects for the SDGs in relation to various perspectives on global governance, with special reference to norm-setting: Ruggie’s concepts of ‘global public domain’ and ‘polycentric global governance’, Risse and Sikkink’s ‘norms cascade’, Murphy’s posited required elements for progressive global innovation, and Raskin’s model of transition through responses to crises. It concludes with questions for further work, including regarding the possibly problematic absence of an explicit inspirational value-core. (shrink)

Three themes in the work of Louis-Joseph Lebret (1897–1966) have especial relevance for current development ethics: first, the importance of counterbalancing a disciplinary philosophical or theological orientation with strong bases in empirical life-experience, practical learning and social sciences; second, the necessity to study capitalism not only ‘development’, and concrete life-needs not only a generalised notion of ‘freedom’; and third, the imperative to employ global and cosmopolitan frames besides national and ‘community’ ones. These themes came to distinguish Lebret as a development (...) ethicist. He began with the first and second from the 1930s, under his banner of ‘Économie et Humanisme’. The third emerged later in consequence of his studies across an interconnected world. The paper elucidates and discusses the three themes in turn. The subsequent sections then briefly consider Lebret’s legacies, influence and continuing relevance: directly, within the Catholic Church’s perspectives since the 1960s on human and global development; and indirectly, for secular work on ‘human development’ and in Anglophone development ethics. “Good governance” may be viewed as governance that effectively promotes human rights, human security and human development. This article discusses human security analysis, which in certain ways offers an integration of these “human” perspectives together with a “social” orientation, by combining a person-focus with systematic investigation of the environing systems of all sorts: physical, cultural, organizational. The importance of such analysis is illustrated through the example of climate change impacts and adaptation. The article presents applications of a human security framework (...) in governance, for policy analysis, planning and evaluation issues in climate change and other fields. The concluding section suggests that human security analysis may provide a way to apply insights from social quality analysis to detailed case investigation and policy analysis, while reducing macro-sociological abstraction and neglect of the natural environment. A busca do saber interior exige do filósofo não qualquer conhecimento, mas (...) somente aquele que ele considera como verdadeiro. A great variety of medical conditions are subject to the placebo effect. Although there is mounting evidence to suggest that the placebo effect is related to the expectation of clinical benefit, little is still known about the biochemical bases underlying placebo responses. Positron emission tomography studies have recently shown that the placebo effect in Parkinson’s disease, pain, and depression is related to the activation of the limbic circuitry. The observation that placebo administration induces the release of dopamine in the ventral (...) striatum of patients with Parkinson’s disease suggests a link between the placebo effect and reward mechanisms. In addition to Parkinson’s disease, the placebo-reward model may also apply to other disorders. However, the relative contribution of the different neurotransmitters and neuropeptides that are known to be involved in modulating the activity of the limbic system may be disease-specific. Thus, while the placebo-induced clinical benefit observed in Parkinson’s disease would mostly reflect the release of dopamine in the dorsal striatum, the activation of opioid and serotonin pathways could be particularly implicated in mediating placebo responses encountered in pain and depression, respectively. Apresenta-se, de forma introdutória, a problemática do discurso do aborto frente ao Projeto de Lei nº 1.135/91. Para tanto, apresenta-se um discussão sobre a universalidade da vida, o aborto no código penal brasileiro, a questão do avanço do aborto (...) na realidade brasileira, aborto versus Vida, a proibição da pena de morte e a legalização do aborto no Brasil e o Projeto de Lei nº 1.135/91 no Brasil. Conclui-se afirmando que se espera que no Brasil a sociedade reconheça a gravidade da descriminalização do aborto e cobre do Estado seus direitos fundamentais, principalmente o direito a vida. Figuram-se como questões centrais as teses do naturalismo e convencionalismo, que estruturam o que se entende (...) como instrumentalização da linguagem, e que, hodierno, arremete, enquanto desconstrução desta instrumentalização, a uma epistemologia da linguagem, que fora, de forma capitular no Século V, primada na ideia de essência. Ob eine sportliche Leistung anerkannt wird, hängt maßgeblich davon ab, ob sie im Einklang mit Werten steht, die wir für wesentlich für den Sport halten. Die philosophischen Standardargumente gegen Doping im Sport behaupten eine Unvereinbarkeit von Doping mit Werten wie Fairness, Gesundheit oder Natürlichkeit. Ich möchte im Gegensatz zu diesen Argumenten eine grundsätzliche Unvereinbarkeit von Doping mit dem Wert eines nachhaltigen Umgangs einer Person mit sich selbst behaupten. Wer dopt, so meine These, folgt einem verabsolutierten Leistungsdenken, was aus ethischer Perspektive (...) kritisiert werden kann, wenn man den Wert der Nachhaltigkeit als ethischen Wert annimmt. ZusammenfassungDie von einem multiprofessionellen Behandlungsteam durchgeführte Symptombehandlung bei inkurablen Patienten am Lebensende erweist sich als hoch effektiv und verschafft den meisten Patienten eine ausreichende Linderung. Dennoch verbleibt ein Patientenanteil, bei dem auch unter Berücksichtigung physischer, psychischer, sozialer und spiritueller Bedürfnisse kein erträglicher Zustand erreicht werden kann. In diesen Extremfällen können Sedierungsmaßnahmen zur Linderung eingesetzt werden. Der Begriff und das Angebot der terminalen Sedierung sind in vielerlei Hinsicht umstritten. Eine Kasuistik soll die Problemstellung veranschaulichen und zeigen, wie die terminale Sedierung von (...) erfahrenen Behandlern als ergänzendes Instrument der Symptombehandlung eingesetzt werden kann, auch wenn sie keine perfekte Antwort auf unerträgliches Leiden in der Sterbesituation darstellt. Résumé Le cadran solaire analemmatique est présenté pour la première fois par un mathématicien français, appelé Vaulezard, dans un petit fascicule publié en 1640. Suit un deuxième ouvrage, plus complet, en 1644. Dernier venu, ce cadran attire l'attention d'importants savants tels que Foster et Lalande. Parfait dès le départ, il a néanmoins la singulière particularité d'inspirer diverses tentatives d'amélioration, plutôt infructueuses, et d'être à l'origine de quelques variétés de cadrans analemmatiques qui, elles, connaissent un franc succès. Nous apportons la preuve (...) trigonométrique et, pour la première fois semble‐t‐il, la preuve géométrique de sa validité astronomique en suivant fidèlement la méthode de construction indiquée par Vaulezard. Nous effectuons, en outre, un survol aussi exhaustif que possible des différents modèles dérivés de ce cadran ainsi que de la littérature les concernant. Summary The analemmatic sundial was briefly presented for the first time in 1640 by the French mathematician Vaulezard and was described in more detail by him in 1644. The analemmatic dial is the last genuine sundial to be invented and it has attracted the attention of some important scholars such as Foster and Lalande. Although perfect from the very beginning, it had the unusual particularity of inspiring several unfortunate attempts at its improvement as well as being at the origin of a few other types of analemmatic dials, which met with a certain success. We provide here the trigonometric proof and for the first time, the geometric proof of its astronomical validity by closely following the construction method of Vaulezard. We also make a comprehensive survey of the different kinds of analemmatic sundials and of their literature. (shrink)

Feminist philosophers of religion have drawn attention to desire as a neglected category for approaching the sources and concerns of religion. This paper extends this discussion by engaging with one particularly disturbing aspect of the writings of the Marquis de Sade. In a world where ultimate sexual pleasure is derived from destruction of the Other, Sade glories in describing the suffering of mothers, often at the hands of their own children. This paper offers one possible reading of these dark desires (...) through employing aspects of psychoanalytic theory to suggest that, rather than isolate him from the majority of humanity, we might consider possible connections between the desires he details and our own. This involves considering the ambivalence of the mother, and thus challenging the idealization of the all-caring, all-nurturing mother. (shrink)

Die öffentliche Wahrnehmung der Forschung mit extrakorporalen Embryonen bildet den Kern des vorliegenden Beitrags. Hierzu wurden über 400 Personen schriftlich befragt. Die Art der Embryonengewinnung (künstliche Erzeugung vs. überzählige Embryonen) wird als bedeutsam für die Bewertung der Forschung angesehen. Mehrheitlich besteht der Wunsch nach rechtlich klaren Grenzen. Die größte Ambivalenz zeigt sich hinsichtlich der Frage nach einer gesetzlichen Erlaubnis der Embryonenforschung. Umgekehrt hat die Bevölkerung eine eindeutigere Meinung zum Verbot von Embryonenforschung und zur Einführung strikter rechtlicher Regelungen. Die Wahl der (...) Mittelkategorie bei der Untersuchung der Einstellung ist durch das Ausmaß der Ambivalenz mitbestimmt. Es konnte nachgewiesen werden, dass Laien das Dilemma der Embryonenforschung ähnlich bewerten wie Experten. Der Wunsch nach einer Freigabe der Forschung mit Embryonen besteht bei einer Teilgruppe, jedoch ist dieser Wunsch von einem hohen Ausmaß an Ambivalenz begleitet. (shrink)

Auguste Comte (1798-1857) und Raoul Heinrich Francé (1874-1943) hatten einen ungewöhnlichen (nicht-akademischen) Zugang zu Wissenschaft. Francé bezog sich in seiner biozentrischen Philosophie (lebensbezogene Natur- und Weltanschauung) immer wieder auf Comte und andere Positivisten. In Entwicklungsprozessen sahen beide Harmonie und Ordnung gegenstrebiger Vorgänge. Konkrete Wahrnehmung und Experimente sind an Beobachtungen geknüpft, durchaus frei von metaphysischen Überhöhungen (Positivismus). Obwohl sie den zeitgenössischen Fortschrittsoptimismus nicht teilen, sind sie doch unermüdliche Befürworter des Lebens in Mannigfaltigkeit und Singularität.

Ein Argument gegen die ärztliche Beihilfe zum Suizid lautet, Patienten könnten sich um Suizidassistenz bemühen, weil sie sich als Belastung empfinden. Dabei wird die Selbstbestimmtheit eines so motivierten Todeswunsches in Frage gestellt. Ist dieses Argument überzeugungskräftig? Empirische Daten zeigen, dass die ärztliche Beihilfe zum Suizid auf der Grundlage dieses Motivs den ethischen Prinzipien der Sorge um das Patientenwohl und des Respekts vor der Autonomie des Patienten nicht widersprechen muss. Denn das Empfinden, anderen zur Last zu fallen, kann trotz adäquater palliativmedizinischer (...) Betreuung wesentlich zu einem Leidensdruck am Lebensende beitragen. Zudem ist dieses Motiv eng verknüpft mit der Sorge um das Wohl der Angehörigen, die einer erheblichen Belastungssituation ausgesetzt sein können. Da aber das Wohlergehen der Familie zu den elementaren Werten von schwerstkranken Patienten am Lebensende gehört, kann der Wunsch nach ärztlicher Beihilfe zum Suizid auch auf der Basis dieses Motivs Ausdruck eines selbstbestimmten Patientenwillens sein. Andererseits korreliert das Empfinden, anderen zur Last zu fallen, mit einer depressiven Verstimmung. Dieser Zusammenhang ist deshalb relevant, da bei depressiven Störungen eine Einschränkung der Selbstbestimmungsfähigkeit vorliegen kann. Vor diesem Hintergrund sind Zweifel an der Selbstbestimmtheit eines so motivierten Sterbewunsches durchaus begründet. Aufgrund des bestehenden Wissensdefizits bei der Feststellung der Selbstbestimmungsfähigkeit ist die Mitwirkung des Arztes bei einem so motivierten Todeswunsch daher ethisch fragwürdig. (shrink)

Die demografische Entwicklung und der medizinische Fortschritt werden die Problematik der Ressourcenknappheit im deutschen Gesundheitswesen in Zukunft weiter verschärfen. Soll nicht nur kurzfristig akuten Sparzwängen ausgewichen werden, steht – wie in verschiedenen Ländern bereits geschehen – auch Deutschland auf Dauer eine Prioritätensetzung im Gesundheitswesen bevor. Diese sollte in möglichst transparenter Weise nach klaren Kriterien erfolgen. Eines der seit einiger Zeit häufig öffentlich zitierten Kriterien der Verteilung von Mitteln in der Gesundheitsversorgung ist die Eigenverantwortung von Patienten. Deren Berücksichtigung in der Allokation (...) von Ressourcen birgt allerdings zahlreiche Probleme. Der vorliegende Beitrag untersucht die gerechtigkeitstheoretischen Grundlagen und die praktischen Probleme bzw. die möglichen Konsequenzen von Eigenverantwortung als Verteilungskriterium im Gesundheitswesen. Auf der Grundlage eines alternativen gerechtigkeitstheoretischen Vorschlags werden drei Möglichkeiten skizziert, Eigenverantwortung von Patienten im deutschen Gesundheitswesen in gerechter Weise stärker zu betonen. Der Selbstbestimmungdes Patienten kommt in der modernen Debatte über das Gesundheitswesen eine zentrale Bedeutung zu. Selbstbestimmung ist aber ein voraussetzungsvoller Begriff, der für Patientengruppen wie Demenzbetroffene, deren Entscheidungs- und Einwilligungsfähigkeit nachlässt oder nicht mehr gegeben ist, eine Reihe von Fragen aufwirft. Auf der Grundlage der jeweiligen Symptomentwicklung der Demenzerkrankung und eigener Erfahrungen im Umgang mit Demenzbetroffenen wirdde rEntwicklungdes Willens in den verschiedenen Stadien der Demenz nachgegangen. Dabei wird den Dimensionen der Differenziertheit der Denkinhalte, der Beurteilungsbasis und der Entscheidungskonstanz eine besondere (...) Bedeutung zugemessen und für eine Graduierung der Selbstbestimmungsmöglichkeiten im Umgang mit Demenzbetroffenen plädiert. Wegen der Schwererkennbarkeit der oft verschlüsselten Willensbekundungen Demenzbetroffener wird der Willenswahrnehmung und dem Training der genauen Beobachtung, Einfühlung und Sensibilität im Umgang mit den Betroffenen großes Gewicht beigemessen. Als Ziel wird die jeweils weitestgehende Selbstbestimmung, im Verlaufe der Erkrankung auch Teilselbstbestimmung und schließlich Mitwirkung bei der individuellen Wohlbestimmung im Sinne eines Grundrechtsschutzes vertreten. Gedächtnis-Enhancement oder Memory-Enhancement ist ein Teilbereich der verschiedenen Ansätze zur pharmakologischen und technischen Verbesserung menschlicher Leistungsfähigkeit. Wie Erfahrungsberichte von Menschen mit von Natur aus gesteigertem Erinnerungsvermögen zeigen, ist eine Steigerung der Gedächtnisfähigkeit prinzipiell möglich. Allerdings verweisen diese Erfahrungen auch auf einige Komplikationen und Beschwernisse infolge dieser gesteigerten Leistungsfähigkeit. Es wird argumentiert, dass erstens diejenigen philosophischen Theorien, die die Funktion des Gedächtnisses v. a. in der Speicherung von Informationen lokalisieren, einige dieser Probleme nicht antizipieren und nur unzulänglich erklären können. Zweitens wird (...) argumentiert, dass philosophische Konzepte zur Funktion von Erinnern und Vergessen, die deren Bedeutung bei der Bildung eines normativ geleiteten Selbstverständnisses in den Vordergrund stellen, diese und weitere mögliche Komplikationen deutlicher in den Blick bekommen können. Beispielhaft wird hier auf Ansätze von Ricoeur und Nietzsche eingegangen. (shrink)

Die jüngste höchstrichterliche Rechtsprechung zur Selbstbestimmung der Patienten und zur Normierung medizinischer Handlungen am Lebensende hat eine intensive Debatte ausgelöst. Das Urteil und die akademisch vorgetragene Kritik werden einer grundlegenden medizinethischen Analyse unterworfen. Sie betrifft die objektive Eingrenzung der Zulässigkeit einer Behandlungsbegrenzung und die Subsumtion des Wachkomas als irreversibel tödliches Grundleiden, das ärztliche Ermessen bei der Indikationsstellung, die normative Einordnung einer Ernährungstherapie am Lebensende und die Verbindlichkeit von Patientenverfügungen. Die medizinethische Kritik offenbart eine unzureichende Wahrnehmung medizinischer und medizinethischer professioneller Dokumente (...) und den Rückgriff auf medizinethisch veraltete Konzeptionen der Sterbehilfe durch das Gericht. Die Folge ist eine fehlerhafte Subsumtion der Wachkomapatienten in die Kategorie irreversibel tödlicher Erkrankungen und eine inhaltliche Schwächung der Verbindlichkeit von Patientenverfügungen. Beides bedarf dringend der Korrektur. (shrink)

In der Medizinethik sind der Respekt vor der Patientenselbstbestimmung, das Nichtschadensgebot, das Handeln zum Wohl des Kranken und das Gerechtigkeitsgebot praxisrelevante Prinzipien. Anhand des Beispiels der Frühintervention und Akutbehandlung schizophrener Störungen wird aufgezeigt, dass es in der psychiatrischen Praxis zu einer Kollision dieser Prinzipien kommen kann. Der frühe Krankheitsbeginn und der häufig chronische Verlauf schizophrener Störungen führen zu großem Leid der Betroffenen und ihrer Angehörigen sowie zur ökonomischen Belastung der Solidargemeinschaft. Die negativen Folgen einer verzögerten Intervention stehen den Risiken der (...) Stigmatisierung sowie den möglichen Nebenwirkungen durch die psychotherapeutische oder psychopharmakologische Behandlung gegenüber. Es wird für eine an der konkreten Situation orientierte, lebensnahe und dynamische Ethik plädiert, die vom konkreten Fall aus diskutiert und verschiedene Perspektiven berücksichtigt – mit dem Ziel von einer Arztethik und Patientenethik zu einer Verantwortungspartnerschaft zu gelangen.
